Estate Planning
a. Assisting with the preparation of a new Will.
b. Clarification of Estate assets and non-Estate assets, including:
i. Whether Estate assets can be distributed in accordance with the client’s will to nominated beneficiaries.
ii. If non-Estate assets sit outside the will and what different legal rules may apply to the distribution of these assets?
iii. Binding death benefits nomination in superannuation.
iv. Identify potential family provision claims.
c. Drafting Enduring Powers of Attorney, General Powers of Attorney, and Enduring Guardian documents.

Deceased Estates
a. Assist executors to perform their duties, including:
i. Applying for a Grant of Probate to the Supreme Court if the deceased person has a valid Will.
ii. Applying for Letters of Administration to the Supreme Court if the deceased person does not have a Will or the Executors are unable to act.
iii. Applying for a Reseal to the Supreme Court if the deceased person’s assets are located in a state or territory of Australia that is different to their primary home at the time of their death.
b. Acting as Executor for deceased estates.
Estate Administration
a. Assist Executors to administer the Estate.
b. Discovery of Estate assets and non-Estate assets, including:
i. Identifying outstanding debts
ii. Superannuation
iii. Taxation associated to the deceased Estate
iv. Property held by the deceased person
v. Shares held by the deceased person
vi. Unpaid dividends
c. Linking with the deceased’s financial advisor and accountant to assist in finalising the deceased’s date of death tax return and Estate tax returns.
Who We Are
Welcome to Purdam Legal
Tracey Purdam is Principal of Purdam Legal and practices primarily in Estate Planning, Probate and Letters of Administration for deceased estates. Prior to practising law, Tracey was a senior executive of non-for-profit organisations and Commonwealth statutory organisations in the sport and alcohol (and other drugs) sectors.
Tracey consults with financial advisors, accountants, barristers and other lawyers to deliver specialised estate planning and estate administration services to our clients.
